1. INTRODUCTION

This Shipping Policy (“Policy”) defines the terms, conditions, and procedures under which Pro Capital Art Ltd. (“PCA”, “Company”) arranges, manages, and delivers artworks, sculptures, antiques, and collectibles (the “Products”) purchased by customers (“You”, “Customer”, or “Buyer”) through the official website https://procapitalart.com (“Website”).

This Policy forms an integral part of the Company’s Public Offer Agreement and must be read in conjunction with the Refund & Returns Policy, Privacy Policy, and Terms of Use.
By placing an order, You confirm that You have read, understood, and accepted the terms set forth herein.

2. GENERAL SHIPPING TERMS

2.1. PCA organizes delivery of all Products worldwide through reputable, licensed courier services and fine-art logistics providers specializing in the safe transportation of artworks and antiques.

2.2. All shipments are prepared and packaged in accordance with international art transport standards, ensuring the safety, integrity, and preservation of each item during transit.

2.3. Each Product is dispatched from our fulfillment centers or partner galleries after full payment has been received and verified by our payment processor.

2.4. Estimated delivery times and applicable shipping rates are displayed during checkout and confirmed in the order acknowledgment email.

2.5. Shipping times are estimates only and may vary due to customs clearance, force majeure, or delays beyond PCA’s reasonable control. PCA shall not be liable for delivery delays caused by such circumstances.

3. SHIPPING DESTINATIONS AND RESTRICTIONS

3.1. PCA delivers to most countries globally, except jurisdictions restricted by international trade sanctions or export control regulations.

3.2. Delivery is unavailable to regions or countries listed in the Company’s Prohibited Countries List (as referenced in Section 2 of the Terms of Use).

3.3. Certain fragile, oversized, or regulated antique items may be subject to export permits, cultural property restrictions, or customs inspections under UNESCO and EU Cultural Goods Regulations.

  • In such cases, PCA will handle all legal documentation in compliance with applicable laws, but delivery timelines may be extended.

3.4. Customers are responsible for verifying import eligibility of purchased items within their jurisdiction prior to placing an order.

4. SHIPPING COSTS AND INSURANCE

4.1. Shipping costs are calculated at checkout based on the Product’s weight, size, value, and destination.

4.2. The total cost of shipping, including handling, packaging, and insurance fees, will be clearly displayed prior to order confirmation.

4.3. All shipments are fully insured for their declared value during transit. Insurance covers loss or physical damage occurring between dispatch and delivery, excluding events arising from improper handling by the recipient.

4.4. In case of international deliveries, the Buyer shall be responsible for customs duties, import taxes, and clearance fees imposed by local authorities, unless expressly included in the final invoice.

4.5. PCA assumes no responsibility for delays or charges resulting from non-payment of customs or import-related fees by the Customer.

5. PACKAGING STANDARDS

5.1. All artworks and antiques are packed by professionals trained in museum-grade handling techniques, using acid-free wrapping, foam reinforcement, and rigid shipping containers.

5.2. Fragile or valuable items may be shipped in custom wooden crates with climate-control materials to prevent temperature or humidity damage.

5.3. Packaging materials are chosen to balance protection, environmental sustainability, and regulatory compliance for cross-border shipments.

6. DISPATCH AND DELIVERY TIMELINES

6.1. Average dispatch time for standard items is 3–7 business days after payment confirmation.
Items requiring authentication, framing, restoration, or export documentation may require additional processing time.

6.2. Delivery timeframes vary by region:

  • United Kingdom: 3-10 business days

  • European Union: 5-14 business days

  • North America: 7-21 business days

  • Rest of the World: 10-30 business days

6.3. Customers will receive a shipment confirmation email with a tracking number once the order is dispatched.

6.4. PCA is not responsible for delays due to incorrect delivery information provided by the Customer or for failure to collect the parcel from the courier.

7. RECEIPT AND INSPECTION UPON DELIVERY

7.1. Upon delivery, the Customer must carefully inspect the packaging and Product condition in the presence of the courier.

7.2. If visible damage or tampering is detected:

  • The Customer must refuse acceptance or record the damage on the courier’s delivery slip;

  • Photographs of the damage must be taken immediately;

  • The Customer must notify PCA by email at info@procapitalart.com within 48 hours of delivery.

7.3. Claims submitted after this period may not be accepted due to carrier and insurer policy limitations.

7.4. Once the Product is accepted and signed for without notation of damage, the shipment shall be considered delivered in good condition.

8. UNDELIVERED OR LOST SHIPMENTS

8.1. In the rare event that a shipment is lost or misdirected, PCA will initiate an investigation with the courier and insurance provider.

8.2. A replacement, store credit, or refund (as applicable) will be issued once the claim has been confirmed and the loss officially acknowledged by the carrier.

8.3. PCA shall not be liable for losses resulting from incorrect delivery details provided by the Customer or for unclaimed packages returned to sender.

9. SPECIAL SHIPPING FOR HIGH-VALUE ITEMS

9.1. For artworks, antiques, or collectibles exceeding a declared value of £10,000 (or equivalent), PCA may arrange dedicated fine-art courier services with personalized handling, customs management, and direct delivery.

9.2. Such shipments may require identity verification, import/export permits, or additional insurance arrangements. The Customer will be informed in advance of any special requirements or charges.

10. FORCE MAJEURE

10.1. PCA shall not be responsible for any delay, failure, or partial performance caused by circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, transport disruptions, customs actions, wars, pandemics, or governmental restrictions.

10.2. In such cases, the performance of obligations shall be suspended until the force majeure event ceases, and PCA will promptly notify affected Customers.

11. TITLE AND RISK TRANSFER

11.1. Ownership of the Product passes to the Buyer only after full payment has been received by PCA.

11.2. Risk of accidental loss or damage transfers to the Buyer upon physical receipt of the shipment or upon signature of the delivery confirmation form.

11.3. In cases where the Customer designates a third-party recipient or forwarding agent, risk is deemed transferred at the time of handover to that party.

12. CUSTOMER RESPONSIBILITIES

12.1. The Customer shall ensure:

  • the accuracy of delivery information provided during checkout;

  • accessibility of the delivery location for standard courier access;

  • timely response to courier contact and delivery attempts.

12.2. Re-delivery costs resulting from failed delivery attempts or incorrect information shall be borne by the Customer.

13. GOVERNING LAW AND DISPUTE RESOLUTION

13.1. This Policy shall be governed by and construed in accordance with the laws of the United Kingdom, without prejudice to any mandatory consumer protection rights under local law.

13.2. Any disputes arising from or relating to shipping, delivery, or insurance matters shall first be resolved amicably through negotiation or mediation (ADR).

13.3. If the Parties fail to reach an amicable solution within 30 calendar days, the matter shall be referred to the competent courts of the United Kingdom, whose decision shall be final and binding.
