1. INTRODUCTION
This Refund & Returns Policy (“Policy”) establishes the procedures and conditions under which Pro Capital Art (PCA) accepts product returns, cancellations, and refund requests.
The Policy applies to all purchases made via our official Website at https://procapitalart.com (the “Website”), including artworks, sculptures, collectibles, and antique items (collectively, the “Products”). By placing an order, you (“Customer”, “You”, “Your”) confirm that you have read, understood, and agreed to this Policy, together with our Terms of Use and Privacy Policy.
2. NATURE OF OUR PRODUCTS
Our collection includes artworks, limited editions, and antique items, each of which may vary in condition, age, and appearance.
All items are sold as described and accompanied, where applicable, by supporting documentation or certificates of authenticity.
Please note that due to the unique and delicate nature of art and antiques, minor imperfections, wear, or signs of aging do not constitute a defect and are considered an inherent part of the item’s authenticity and historical value.
3. ELIGIBILITY FOR RETURNS
We want our Customers to be fully satisfied with their purchases; however, due to the specific nature of art and antiques, return eligibility is strictly regulated.
A return or refund request may be considered if:

The Product received differs materially from its online description or provided photographs.

The Product arrives damaged in transit or defective due to improper handling prior to delivery.

The wrong item was delivered.
To be eligible for return, the Customer must:

Notify PCA in writing at info@procapitalart.com within 7 calendar days of delivery; and

Provide clear photographic evidence and a detailed explanation of the issue; and
-
Ensure the Product remains unused, undamaged, and in the same condition as received, including all original packaging, certificates, and accessories.
PCA reserves the right to refuse returns if the item has been:

Damaged after delivery;
-
Altered, reframed, or restored by the Customer or third parties;
-
Exposed to inappropriate conditions (humidity, light, or temperature).
4. NON-RETURNABLE ITEMS
The following categories are not eligible for return or refund unless otherwise required by applicable law:

Custom or commissioned artworks;
-
Limited edition items created specifically upon request;
-
Digital reproductions or downloads;
-
Antique pieces sold “as is”;
-
Items damaged due to improper handling or neglect after receipt.
5. RETURN PROCEDURE
If your return request is approved:

PCA will provide written authorization and detailed return instructions.

The Customer must safely repack the item using the original materials or equivalent professional packaging.

The Customer shall be responsible for all return shipping costs, customs duties, and insurance, unless the return is due to an error by PCA.

PCA recommends using a trackable and insured courier service.
Upon receipt, PCA will inspect the returned item within 5-10 business days. If the return is validated, the refund will be processed according to Section 6 below.
6. REFUND CONDITIONS AND METHOD
Approved refunds will be issued:

To the original payment method used at checkout;

Within 14 business days of confirming the return;
-
In the same currency as the original transaction.
Refunds will cover only the cost of the Product. Shipping, handling, and insurance fees are non-refundable, except where the return results from an error attributable to PCA.
If an item was purchased using a promotional discount or coupon, the refund amount will reflect the discounted purchase price.
7. DAMAGED OR LOST SHIPMENTS
All shipments are professionally packaged and insured during transit.
If your item arrives visibly damaged, please:

Refuse delivery or sign the courier’s damage report;

Notify us at info@procapitalart.com within 48 hours of receipt, attaching photographs of the damage;

Retain all packaging for inspection by the insurer or courier company.
Claims submitted after the stated deadline may not be accepted due to insurance limitations. PCA will assist Customers in liaising with couriers to resolve damage or loss claims.
8. ORDER CANCELLATIONS
Orders for available stock items may be canceled within 24 hours of purchase, provided they have not yet been shipped.
Custom commissions, made-to-order artworks, and antique pieces reserved or sold at auction are non-cancellable.
Once an item has been dispatched, cancellation requests will be treated as a return and processed under this Policy.
9. AUTHENTICITY AND MISREPRESENTATION
Each item sold by PCA undergoes careful authentication. If, at any time, verifiable and credible evidence arises proving that an artwork or antique is inauthentic, PCA will offer a full refund upon return of the item, provided that:

The claim is supported by a report from a recognized expert or institution;

The item is returned in the same condition as purchased; and
This guarantee does not extend to differences in interpretation, attribution, or changes in scholarly opinion that occur after the date of sale.
10. LIABILITY LIMITATION
PCA shall not be liable for:

Delays or loss during return transit caused by courier services;

Damage due to improper packaging or storage by the Customer;
-
Variations in color, tone, or texture between the physical item and digital images;
-
Subjective dissatisfaction (e.g., “change of mind” or artistic preference).
The Company’s total liability in any return or refund case shall not exceed the original purchase price of the item.
11. GOVERNING LAW AND DISPUTE RESOLUTION
This Policy and any disputes arising out of it shall be governed by the laws of the United Kingdom, without regard to conflict-of-law principles.
